ANNEX 8 EXECUTIVE ORDER NO. 04

REPUBLIC OF LIBERIA

EXECUTIVE ORDER NO. 04-2000

AN EXECUTIVE ORDER BY THE PRESIDENT OF LIBERIA TO ALLOCATE AND GIVE CERTAIN PORTIONS OF FEES AND CHARGES PAID AND COLLECTED, BE PAID TO AND USED BY THE FORESTRY DEVELOPMENT AUTHORITY FOR THE SUPPORT AND MAINTENANCE OF THE FOREST LAND OF LIBERIA.

RECOGNIZING the irregular and inadequate funding of the Forestry Development Authority which has hampered the ability of the Authority to properly maintain, manage and regulate the Forest Land of Liberia; and

NOTING that because of this, the Forestry Development Authority is under manned and in arrears to its employees with respect of the payment of salaries and benefits to them; as well as to meet the cost and expense of proper maintenance, management and regulation of the Forest Land and Forest Resources of Liberia; and

FURTHER REALIZING that there is an urgent need to provide and ensure that the Forestry Development Authority receive regular and adequate funds to meet the necessary and proper financial requirement for its man power deployment and its other administrative functions and duties.

NOW, THEREFORE AND IN VIEW OF THE ABOVE, it is ordered and directed that certain portions of fees and charges as stipulated below, paid and collected, for land rental, stumpage fees, conservation fees and reforestation fees, be allocated and paid to and used by, the Forestry Development Authority, for the support and maintenance of the forest land of Liberia; so as to facilitate the Authority in the execution and implementation of its statutory and related duties, as follow to wit:

  1. LAND RENTAL:  That Fifty (50%) percent but not less than twenty five cents or ($0.25 United States Dollars) per acre of forest land rental, paid by HOLDER/OPERATOR of Forest Resource Utilization Agreement with the Government of Liberia, be allocate and paid directly into an account designated by Forestry Development Authority; and

  2. STUMPAGE FEES:  that two (2%) percent but not less than one (1.00) United States Dollars paid for each cubic meter of logs extracted, be allocated and paid directly to the account of Forestry Development Authority as designated by the Authority; and

  3. CONSERVATION FEES:  That two (2%) percent but not less than one ($1.00) United States Dollars of the amount paid as conservation fees be allocated and paid directly into the account of the Forestry Development Authority as designated by the Authority; and

  4. REFORESTATION FEES:  That two (2%) percent but not less than one ($1.00) United States Dollars paid as reforestation fees be allocated and paid directly into the amount of Forestry Development Authority as designated by the Authority.
