OPERATION OF TRUST FUNDS - OPERATIONAL (TECHNICAL)
AND ADMINISTRATIVE SERVICING COSTS

I. What is the purpose of overhead charges on trust fund operations?

  1. Overhead charges in international organizations are levied to counterbalance the costs of technical and administrative services which are a necessary and inherent part of any “extra-budgetary” operational project that the organization agrees to perform, but which because of their nature, cannot be readily, clearly, or directly singled out for charging to the project itself.

  2. Technical services may include such items as:

    1. negotiating agreements with project-sponsoring bodies and recipient governments and reporting periodically to both on progress;

    2. technical advice and review of project proposals;

    3. location and recommendation of qualified technical personnel;

    4. technical support, guidance and supervision of the execution of projects;

    5. review and editing of reports of exports.

  3. Administrative services may include such items as:

    1. recruitment, briefing and personnel administration of experts;

    2. servicing of fellowships, including placement and formulation of study plans;

    3. procurement of supplies and equipment and provision of office supplies and stationery;

    4. receipt and disbursement of funds, maintenance of accounts, financial reporting, audit, etc.;

    5. communications and related services, dispatch of publications;

    6. medical services, where provided.

  4. Unless the costs of the above items (that is “overhead costs”) are recognized and charged to the extra-budgetary project originating them, they must be met from the regular budget of the Organization and, if this happens, then either that budget must be increased or some part of the approved program of work must be curtailed.

II. What is the basis for levying such overhead charges?

  1. Member Governments themselves, through the legislative and governing bodies of the United Nations and its specialized agencies, have established the principle that each operational fund should contribute to the overhead costs associated with its administration.

  2. Thus, each year the various United Nations agencies are provided with a lump sum allocation toward the administrative and operational costs of EPTA projects which they carry out. (In 1963 this will equal 12 percent of one half of total value of approved projects in the 1961–1962 biennium). Similarly, the various United Nations organizations receive, within the allocation for each United Nations Special Fund project for which they are the executing agency, a component for overhead costs.

  3. The Conference, Council and Finance and Program Committees of the Organization have taken the view that such programs should in principle bear full additional costs of such operations, so as to avoid pressures on Regular Program resources and staff of the Organization. This principle indeed is implied in Financial Regulation 6.7 which states:

    “Voluntary contributions, whether or not in cash, may be accepted by the Director-General, and trust and special funds may be established by him to cover monies made available to the Organization for special purposes, provided that the purposes of such contributions and monies are consistent with the policies, aims and activities of the Organization. The purposes and limits of any trust and special funds shall be clearly defined. The acceptance of any such contributions and monies which directly or indirectly involves additional financial obligations for Member Nations and Associate Members shall require the consent of the Conference. Trust and special funds and voluntary contributions shall be administered in accordance with the Financial Regulations of the Organization, unless otherwise provided for by the Conference. Trust and special funds shall be reported to the Finance Committee.”

  4. In line with this principle the Organization, on the recommendation of the Finance Committee, requests the payment of a surcharge of 12 percent of each trust fund which it administers to defray overhead costs, except that:

    1. if the fund is established substantially for the procurement of equipment, the surcharge is reduced to 5 percent, and

    2. where the trust fund represents a special contribution to implement certain aspects of the Program of Work or a deposit for emergency procurement for a government which involves a minimum of work and insignificant costs, the surcharge may be reduced or waived.

III. Why is the overhead charge expressed as a percentage of the total cost of the operation?

It is difficult to appraise just now much additional expenditure falls upon the organization as the result of trust fund activities as a whole, and it would be even more difficult to attempt to evaluate such expenditure for each project individually. Experience has shown, therefore, that the application of a uniform standard (that is, percentage) charge, subject to variation in exceptional circumstances, is the most feasible practice to follow.

APPENDIX D
AGREEMENT BETWEEN THE FOOD AND AGRICULTURE ORGANIZATION OF THE UNITED NATIONS AND THE DESERT LOCUST CONTROL ORGANIZATION FOR EASTERN AFRICA

PREAMBLE

The Desert Locust Control Organization for Eastern Africa (hereinafter referred to as “the DLCO for EA”), established by Convention between the Governments of Ethiopia, France, the Somali Republic, Tanganyika, and of Kenya and Uganda acting with the authority and consent of the Government of Great Britain and Northern Ireland

And the Food and Agriculture Organization of the United Nations (hereinafter referred to as “FAO”),

Desiring to co-ordinate their efforts in the promotion of control and research of the desert locust in the light of the Constitution of FAO and of the Convention for the establishment of the DLCO for EA (hereinafter referred to as “the Convention”)

Considering that Article IV, paragraph 11 of the Convention provides for close co-operation with FAO and for the co-ordination of activities in the field of locust control

Have agreed as follows:

Article I

PURPOSE OF THE AGREEMENT

1. The purpose of the Agreement shall be to ensure co-operation between FAO and DLCO for EA by consultation, co-ordination of effort, mutual assistance and joint action in fields of common interest in accordance with the objectives and principles of FAO and the DLCO for EA.

2. Arrangements shall be made between the contracting parties concerning mutual assistance and joint action. Such arrangements shall carefully define the manner and extent of participation by each party and shall specify the financial commitment, if any, that each party is to assume.

Article II

RECIPROCAL REPRESENTATION

1. The DLCO for EA shall be invited to send an observer to sessions of appropriate FAO bodies dealing with desert locust control.

2. FAO shall be invited by DLCO for EA to send an observer to the regular sessions of its Council and may also be invited to special sessions of the Council.

Article III

EXCHANGE OF INFORMATION

1. The Director-General of FAO and the Director of the DLCO for EA shall keep each other fully informed of all programs of work and projected activities of their respective organizations which may be of mutual interest.

2. The DLCO for EA shall keep FAO fully informed, by means of monthly reports, of the infestations of desert locusts in the region as defined in the Convention and shall transmit to FAO any other reports regarding the technical activities of DLCO for EA.

3. FAO shall supply to the DLCO for EA all appropriate documents pertaining to the desert locust which are circulated by FAO to its Member Nations and Associate Members and to its desert locust bodies, as well as any other relevant FAO publications.

Article IV

CO-ORDINATION AND CO-OPERATION

1. In the interests of co-ordination of desert locust control activities in the region as defined by the Convention, FAO, in implementing its activities and programs in the said region, shall give due consideration to the functions of the DLCO for EA.

2. Co-operation by the DLCO in the locust control activities of governments not signatories to the Convention shall, as appropriate and as far as possible, be effected through FAO.

Article V

EXPENSES

1. The DLCO for EA undertakes to provide in advance the funds necessary to meet the expenses which, apart from the financial commitments referred to in Article I.2 above may be incurred by FAO in the implementation of this Agreement. To this effect the DLCO for EA shall pay each year, into a Trust Fund to be established by the Director-General of FAO, an amount to be determined annually by mutual agreement between the two parties. The Trust Fund will be administered by the Director-General of FAO in accordance with the Financial Regulations of FAO.

Article VI

FUTURE CO-ORDINATION OF REGIONAL AND INTERNATIONAL ACTION

1. FAO and the Council of DLCO for EA shall give due consideration to the possibility of bringing, at an early date, the DLCO for EA within the framework of FAO under the relevant provisions of the FAO Constitution, so as to secure the control of the desert locust and research in this field on a wider international basis.

2. Any recommendation or resolution formulated on this subject by the Council of the DLCO for EA should be transmitted to the Director-General of FAO for consideration and possible action by the Director-General, the Council or the Conference of FAO, as may be appropriate.

Article VII

TERMINATION

The present Agreement may be terminated by either party by giving one year's notice of such termination. It shall automatically lapse as the result of the conclusion of an international agreement as envisaged in Article VI.1 of the present Agreement.

Article VIII

AMENDMENTS

The present Agreement may be amended by mutual consent of the contracting parties.

Article IX

ENTRY INTO FORCE

The present Agreement shall come into force on approval by the Council of DLCO for EA and the Council of FAO, subject to confirmation by the Conference of FAO.
