LEGISLATION
-Foreign fishing other than research or sport fishing is authorized only under bilateral agreement and licence.
(Sect. 7)
-Licence may not be granted to any vessel whose owner or operator is not a national of the foreign state which is a party to the fishery treaty. (Sect. 9)

LEGISLATION
Local fishing vessel
is defined as a fishing vessel that is owned by a citizen resident or a company registered in the Bahamas in which all the shares are owned by citizens of the Bahamas, resident in the Bahamas. (Sect. 2) (Fisheries Resources (Jurisdiction and Conservation) Act, 1977)

BAHAMAS LEGISLATION
-Conditions and restrictions are set, if deemed by the Minister to be necessary or expedient for regulating conservation and management of fisheries resources.
-Licence shall contain conditions and restrictions such as:
- requirements of any applicable management plan and regulations implementing it;
- licence valid for one vessel;
- vessel allowed to fish only within the area of exclusive fishery zone for which the licence has been granted, and during seasons and periods indicated providing that the vessel shall not engage in the cutting up, canning or packaging of any fishery resource except in said area (Sects. 94)
Controls over transit by unlicensed fishing vessels
-Fishery resources found on board any unlicensed fishing vessel within the exclusive fishing zone or within a protected area shall be deemed, unless the contrary is proved, to have been taken within the zone by person on board that fishing vessel. (Sect. 20(2))
-Application by foreign state for a licence shall specify: names of foreign state, owner and vessel; address and nationality of owner, registration number of the vessel and date of registration; GRT, method of propulsion, processing equipment, type and quantity of fishing gear; description of each fishery resource for which vessels intend to fish, quantities of fish caught; area and season or period in which fishing will be conducted. % = Reports must be made every 3 days for vessels from Norway, Sweden and Faroes when fishing for herring, weekly when fishing for other species .
O = Logbook to be filled out(radio report to be made) after every fishing operation .
* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
