LEGISLATION
Access to the fishery zone of the United States is permitted only under bilateral agreement.
LEGISLATION
Local fishing vessel
must be documented as a U.S. flag vessel, which requires that:
(a) vessel must be owned by nationals or companies incorporated under the local law;
(b) where vessel owned by company, management must be controlled by nationals (i.e., majority of Board of Directors must be U.S. nationals) (no restriction on ownership of shares by non-nationals as such);
(c) vessel must be built in U.S.; and
(d) vessel must be under the sea-going command of U.S. nationals.

-Each Governing International Fishery Agreement to include binding commitment on part of foreign nation and its fishing vessels to comply with specified terms and conditions.
-Permit conditions and restrictions to include:
- requirement of applicable fisheries management plan;
- permit non-transferable;
- no transhipment of fish from U.S. vessels unless authorized.

-Tuna excluded from exclusive management authority of the USA, but billfish and anadromous species spawning in national waters are included. (Sect. 601-11)
-Vessels to display international radio call sign (IRCS) on both sides of deck house in letters/numbers at least 1 m. high (1/2 m. for vessels 20 meters or less). (Sect. 611-5)
-Operators of vessels to comply with enforcement instructions to facilitate boarding and inspection. (Sect. 611-6)
-Vessels to accept observers and to provide facilities and access to communication facilities. (Sect. 611-8)
-Vessels to use caution to avoid collision with fixed gear if using mobile gear. (Sect. 611-11)
-Vessels to maintain plots showing location of fixed gear broadcast by Coast Guard. (Sect. 611-11)

LEGISLATION
-Vessel to notify regional office of National Marine Fisheries Service and Coast Guard of time and location of commencement and cessation of operations at least 24 hours in advance. (Sect. 611-4)
-Vessel to give notice of temporary departures from fishing grounds and return to grounds, and of shifts in fishing area. (Sect. 611-4)
-Vessel to maintain logbook of catch and effort information, and daily cumulative log. (Sect. 611 -9)
-Transfers of fish to be recorded. (Sect. 611-9)
-Records to be available for inspection. (Sect. 611-9)
-Records to be maintained on daily basis of position, amount of catch, date, type of gear, effort. (Sect. 611-9)-Weekly report to be submitted by country representatives showing effort and yield. (Sect. 611-9)

AGREEMENTS
I licensed vessels to provide written reports on size and location of catches taken in Agreement Area. These details must be entered in logbook of each lincensed fishing vessel.

* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
