VANUATU LEGISLATION
Such fees as may be prescribed, plus such royalties or other charges as the Minister, after consulting the Finance Minister, may determine.

Foreign fishing vessel licence fees:
Fee = catch allocation x landed catch value x a percentage of catch value.
(Fee is based on estimated catch, calculated according to vessel capacity, not according to reported catch per trip.)
AGREEMENTS
Treaty on Fisheries between Governments of certain Pacific Island States and U.S.A., renewed on 15 June 1993 for 10 year extension, to be reviewed after 5 years.

LEGISLATION
Licences to be issued to foreign vessels only where access agreement in force with the flag state or vessel owners' association, or where vessel is locally-based.
LEGISLATION
Local vessel defined as any fishing vessel (a) wholly owned by the Government of Vanuatu or any public corporation established by or under any law of Vanuatu; (b) wholly owned by one or more persons who are citizens of Vanuatu; or (c) wholly owned by any company, society or other association of persons incorporated or established under the laws of Vanuatu.
Note: Any fishing vessel which is registered or documented pursuant to the Maritime Act No. 8 of 1981 or any amendment or reenactment thereof is not a "local fishing vessel" for purposes of this Act.
-Locally-based foreign fishing vessel defined as one based in Vanuatu and landing all its catch there.

VANUATU LEGISLATION
-Access Agreements are to include a provision establishing responsibility of foreign country or association for ensuring compliance by its vessels with agreement and fishing laws. (Sect. 3(3))
-Fishing gear must be stowed except where authorized to fish.
-Licences subject to general conditions to be prescribed, and to special conditions specified by the Minister.

-Only those species specified in licence may be caught.
-No fish may be transhipped from or onto the vessel while in Vanuatu waters.
-Vessel to fly the flag of its state, to display identification marks and international radio call sign or number assigned to it.
-Any change in information must be reported within 7 days.
-No fishing to be undertaken unless authorized by licence.
-Vessel to allow observers to board and to provide full access and facilities.
-Vessel to take precautions to avoid damage to local fishing operations.

AGREEMENTS
Pacific Island States/United States Treaty on Fisheries, signed April 1987
-The operator and crew of vessel shall allow and assist an observer designated by the Pacific Island parties. (Annex, part 6)
-Application form contains: full name, radio call sign, registration number of vessel, full names and addresses of each person who is an operator, full name and address of insurer, whether owner or charterer is insolvent, whether operator or vessel has been involved in a treaty violation. (Schedule 1)
-Closed areas: Archipelagic waters, territorial seas, and internal waters.

LEGISLATION
-A logbook is to be kept on board, recording on a daily basis the details of fishing operations.
-Logbook is to be transmitted to the Director of Fisheries or to another authorized person in its original form, within 7 days of completion of voyage or at any time requested by the Director of Fisheries or any authorized officer.
-Vessel must report the following information to Director of Fisheries or authorized person immediately upon entering and leaving, and weekly while in Vanuatu waters: international radio call sign or number assigned to it, position of vessel at time of report, total catch by species on board at time of report, and other matters which the Director may from time to time request.

Port departure and entry into port for unloading:
- report type (LBEG) for port departure to begin fishing and LFIN for port entry for unloading;
- date;
- call sign;
- port name;
- catch on board by species (in short tons).
Weekly reports:
- report type (WEEK);
- date;
- call sign;
- position (to one minute of arc);
- catch on board by species.

Zone entry and exit:
- report type (ZENT for entry and ZEXT for exit);
- date;
- call sign;
- position (to one minute of arc);

Port entry reports:
- report type (PENT);

% = Reports must be made every 3 days for vessels from Norway, Sweden and Faroes when fishing for herring, weekly when fishing for other species .

* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
