LEGISLATION
Licence fees may be prescribed and, in the case of foreign fishing vessels, other charges may also be provided for in an access agreement or as the Minister may otherwise determine.

AGREEMENTS Treaty on Fisheries between Governments of certain Pacific Island States and US.A., renewed on 15 June 1993 for 10 year extension, to be reviewed after 5 years.

  LEGISLATION
-Foreign fishing vessel
defined as fishing vessel other than a local fishing vessel.
-Local fishing vessel defined as a fishing vessel wholly owned and controlled by the Government of Western Samoa; or by a company, society or other association of persons incorporated or established under the laws of Western Samoa, at least 51% of which is beneficially owned by citizens or by the Government of Western Samoa; or by a joint venture, consortium, or partnership arrangement between 2 or more parties, where at least 51% of beneficial ownership and control is vested in or held by citizens or by the Government of Western Samoa.

WESTERN SAMOA LEGISLATION
Licence conditions may include:
-fishing areas, seasons, times and voyages during fishing authorized;
-species, size, age and quantities of fish to be taken;
-methods of taking fish, types, size and amount of gear;
-requirements concerning use, transfer, landing and processing;
-requirements regarding entry into port for inspection;
-compensation payable for damage to local gear, catch, or fish stocks;
-conduct of research;
-acceptance on board of Samoan trainees;
-display of licence, marking of craft;
-compliance with instruction of authorized officers;
-observers on board vessel and reimbursement of costs to Government;
-installation of transponders or other position- fixing equipment;
-carrying of specified nautical charts.

AGREEMENTS
Pacific Island States/United States Treaty on Fisheries, signed April 1987
-The operator and crew of vessel shall allow and assist an observer designated by the Pacific Island parties. (Annex, part 6)
-Application form contains: full name, radio call sign, registration number of vessel, full names and addresses of each person who is an operator, full name and address of insurer, whether owner or charterer is insolvent, whether operator or vessel has been involved in a treaty violation. (Schedule 1)
-Closed areas: Territorial sea, reefs, banks and areas bounded/closed by the following parallels and meridians to the extent that such areas are within Western Samoa fisheries jurisdiction:
1. From latitude 12°58' South to latitude 13°11.5' South and longitude 174°5.5' West to longitude 174°25' West.
2. From latitude 12°12' South to latitude 12°38.5' South and longitude 173°47' West to longitude 174°25' West.
3. From latitude 13°7' South to latitude 13°19' South and longitude 172°59' West to longitude 173°38.5' West.
4. From latitude 14°51' South to latitude 15°3.4' South and longitude 172°59' West to longitude 172°19.1' West.
5. From latitude 14°20.5' South to latitude 14°28' South and longitude 171°8' West to longitude 171°17' West; and in territorial water within 2 nautical miles of any anchored fish aggregating device within the EEZ for which notification of location shall be given by geographical coordinates.

-Licensing area reports:
Port departure and entry into port for unloading:
- report type (LBEG) for port departure to begin fishing and LFIN for port entry for unloading;
- date;
- call sign;
- port name;
- catch on board by species (in short tons).
Weekly reports:
- report type (WEEK);
- date;
- call sign;
- position (to one minute of arc);
- catch on board by species.

Reports to national authorities:
Zone entry and exit:
- report type (ZENT for entry and ZEXT for exit);
- date;
- call sign;
- position (to one minute of arc);
- catch on board by species.
Port entry reports:
- report type (PENT);
- date;
- call sign;
- estimated time of entry into port (GMT)
- port name.

% = Reports must be made every 3 days for vessels from Norway, Sweden and Faroes when fishing for herring, weekly when fishing for other species .
O = Logbook to be filled out(radio report to be made) after every fishing operation .
* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
