LEGISLATION
Licence fee payable by foreign fishing vessel shall be determined by the Minister, on advise of the Committee.

LEGISLATION
-No foreign fishing vessel licence is to be issued unless an access agreement with the flag state or association representing vessel owners is in force. Flag state includes regional organization with delegated power to make agreements.
-Requirement does not apply to licences issued for test fishing operations or locally-based fishing operations.

LEGISLATION
Local fishing vessel
is defined as any fishing vessel
(a) wholly owned by the Government of Antigua & Barbuda or any public corporation established by or under any law; or (b) wholly owned by one or more persons who are citizens of Antigua & Barbuda; or (c) wholly owned by any company, society or other association of persons incorporated or established in Antigua & Barbuda of which at least 51% of the voting shares are held by citizens.
Locally-based foreign fishing vessel defined as one based in Antigua & Barbuda which lands all its catch there.

-Access agreements to include provision establishing responsibility of foreign country or association for taking necessary measures to ensure compliance by its vessels with agreement and fishing laws. (Sect. 7(3))

-Licence application for foreign fishing vessels shall be in a prescribed form and addressed to the Minister. (Sect. 5)
-Licence issued in prescribed form after payment of related fees. (Sects. 6 and 7)
-No foreign fishing licence shall be issued unless the applicant produces a certificate of vessel registration in the Regional Register of OECS, attesting of good standing of the vessel. (Sect. 8)
-Licence includes general conditions, such as: (a) obligation to fish within the limits set in the licence; (b) changes of information to be notified to Chief Fisheries Officer; (c) no transhipment without written permission of Chief Fisheries Officer, (d) compliance with directions from authorized officer; (e) prevention from damage to local fishing operations. (Sect. 9(1))
-Foreign vessel with an overall length 2 60 feet shall: fly the flag of its own State; clearly display vessel identification markings and name; master shall allow any designated observer on board and provide him with all facilities to perform his duty. (Sect. 9(2)(a-h))
-Vessels under 60 feet shall display identification marking and maintain record of catches. (Sect. 9(3))
-Specifications for identification markings of foreign fishing vessel such as international radio call sign, location and size of markings determined.

-Local representative acting on the behalf of the master, the owner or the charterer shall be appointed (Sect. 10)
-Fishing gear shall be stowed in such a manner that it is readily available for fishing, when vessel outside licence conditions. (Sect. 11)
-Fishing of lobsters, turtles, conches confined within restrictive conditions of size, weight, seasons and methods of fishing. (Sects. 20, 21 and 22)
-Minimum size for seine nets = 1.1/2 inches stretched; for mesh wire covering trap or fish pot = 1.1/2 inches in diameter. (Sect. 26)

LEGISLATION
-Master of the vessel shall cause, in a prescribed form, and maintain on daily basis, a logbook, to be submitted at specified times to the relevant authority.
-Master shall cause reports specifying: international radio call sign; vessel position while reporting; total catch by species on board at the time of reporting: other information related to fishing operations.
-Any record, logbook or notification required shall be maintained in English or other language determined by the Minister. (Sect. 9)
