我很高兴地代表联合国粮食及农业组织总干事雅克·迪乌夫欢迎诸位出席关于海龟养护与渔业的本次技术磋商会。本次会议是过去十年中在渔业管理领域，尤其是关于扩大其范围，以包括生态系统和养护关切问题方面所出现的重要发展的良好证明。这些发展在若干国际公约和文书中也得到反映。
1992
年联合国环境与发展会议（联合国环发会议）使环境与人民之间强大的相互依存以及为子孙后代确保可持续性的必要性成为人们关注的焦点。水生生态系统可持续利用的概念—要求在捕鱼时适当考虑环境—成为1995
年通过的粮农组织《负责任渔业行为守则》的一项重要内容。该行为守则尤其涉及生物多样性问题和濒危物种的保护，为此要求尽量减少捕捞非目标品种，无论是鱼类还是非鱼类品种。这种对渔业采取扩大生态系统的方法在2001
年关于海洋生态系统负责任渔业的雷克雅维克声明中得到重申和加强。
据信20
世纪下半叶在沿海地区及深海中的捕捞活动扩展促成了海洋生态系统的重要变化，不仅对目标品种，而且对直接或间接受到渔业活动影响的其它生态系统成分亦如此。由于这些发展，也由于人们对捕鱼间接影响的认识提高，粮农组织发起了若干全球举措，旨在促进实施《负责任渔业行为守则》。例如，联合国鱼类种群协定要求各国通过各种措施尽量减少非目标品种，尤其是濒危品种的捕捞，这些措施应尽可能包括开发和有选择性地采用环境上安全和经济有效的渔具及技术。其它一些文书，如《鲨鱼养护和管理国际行动计划》、《减少延绳钓中误捕海鸟的国际行动计划》等直接涉及易受害品种的捕捞。
海龟也受到渔业的影响。这些动物传统上是因为其肉、蛋、壳和皮而得到开发，
在某些情况下导致当地开发过度，需要采取管理措施，限制或禁止开发与贸易。然而，在许多渔业中海龟也在其分布范围内在许多渔业中被附带捕获，这些分布范围即从世界海洋的温带到热带地区的许多沿海地区和深海。它们还被底层拖网捕获，在绳钓渔具和刺网中被缠住，以及在延绳钓中被钩住。由于世界养护联盟认为所有海龟品种均被视为濒危品种，所以任何海龟或海龟产品的国际贸易均被禁止，因为它们已列入动植物濒危物种国际贸易公约附录I。
海龟养护及与渔业活动的相互影响只是最近才得到粮农组织的注意。该问题是在2001
年粮农组织渔业委员会第二十四届会议上提出的，并在去年第二十五届会议上得到更大关注。该届会议认为“在考虑关于海龟相互影响与养护的现有工作的同时，应于2004
年在泰国曼谷举行一次技术磋商会[……]”。因此粮农组织主办了本次会议，并作为筹备阶段，还举行了一次关于生态系统范围内海龟与渔业之间相互影响的专家磋商会。该专家磋商会的报告含有我们本次会议的大部分技术背景情况。在工作文件中，已将需要结合海龟考虑的重点地区和渔业、可采取的适当管理措施以及法律和社会经济方面的建议提交诸位审议。在这方面，本次磋商会的结果将毫无疑问地直接有助于实施粮农组织《负责任渔业行为守则》，包括对渔业采取生态系统方法，以及实现千年发展目标—确保环境可持续性，尤其是目标9—将可持续发展原则纳入国家政策和计划，并扭转环境资源的丧失。
我相信，诸位的专业知识再加上各种不同的背景以及对可持续渔业管理的真正奉献是高质量磋商的必要和充分保证，随后制定全面的建议将对处理海龟养护与渔业问题的进展作出积极的贡献。这些建议将提交2005
年3 月举行的渔业委员会第二十六届会议审议。
最后，我要感谢日本和美利坚合众国政府对本次技术磋商会议的费用提供慷慨的捐助，使粮农组织秘书处能够组织和举办这次由渔委第二十五届会议授权的重要会议。

序言
粮农组织《负责任渔业行为守则》要求可持续利用水生生态系统，并要求捕捞作业适当注意环境。有些海龟种群因捕捞而受到严重影响，需要立即注意。由于这些种群的严峻状况，建议采取广泛措施，包括除其它养护措施之外减少因渔业造成死亡的措施。
由于对海龟状况的关注以及捕捞海龟种群可能产生的不利影响，粮农组织渔业委员会第二十五届会议（2003
年）提出了海龟养护以及与捕捞作业相互影响的问题，要求就这一问题举行一次技术磋商会审议制定关于在捕捞作业中减少海龟死亡的准则。这些准则是应渔业委员会的要求，根据2004
年3 月在罗马举行的专家磋商会的报告拟定的。
这些准则将用作对编写粮农组织技术准则的投入，并用于指导国家或多边渔业管理活动及其它措施的制定工作，以便对海龟进行养护和管理。这些准则为自愿性质，无法律约束力。它们适用于捕捞作业与海龟之间产生或可能产生相互影响的那些海域和渔业。它们涉及全球范围，但是在实施时需要考虑到国家、分区域和区域的不同情况，包括文化和社会经济差异。
这些准则针对粮农组织的成员和非成员、捕捞实体、有关渔业管理和可持续利用水生生态系统的分区域组织、区域组织和全球组织，无论是政府组织还是非政府组织。
应当在捕捞业、捕捞社区和其他有关利益相关者参与以及如有可能合作的情况下开展与这些准则有关的所有活动。
这些准则的实施应当与《负责任渔业行为守则》相一致，并与关于生态系统考虑及以现有最佳科学知识为基础的《雷克雅维克海洋生态系统负责任渔业宣言》相一致。
1. 捕捞作业
A. 适当处理和放养
为了减少受伤并增加成活机会：
(i) 关于适当处理的要求，包括所有附带捕捞（ 钩住或缠住）的海龟的再生或立即放养。
(ii) 保留及利用必要设备适当放养被附带捕捞或误捕的海龟。
B．沿海拖网
(i) 在沿海虾拖网渔业中，促进使用海龟隔离器或在减少海龟附带捕捞和死亡方面有相同效果的其他措施。
(ii) 在其他沿海拖网渔业中，收集数据， 查明海龟相互影响，必要时对减少海龟附带捕捞和死亡的可能措施进行研究。
(iii) 实施因B(ii)的结果而制定的成功方法。
C．围网
(i) 尽可能避免围住海龟。
(ii) 如被围住或缠住，采取一切可能的措施安全放养海龟。
(iii) 关于可能缠住海龟的聚鱼装置，采取必要措施对聚鱼装置进行监测并放养被缠住的海龟，在不用时收回这些聚鱼装置。
(iv) 开展研究，发展改进的聚鱼装置，减少并消除海龟被缠。
(v) 实施因C(iv)的结果而制定的成功方法。
D．延绳钓
(i) 发展并实施鱼钩设计、鱼饵种类、深度、渔具规格和捕捞方法的适当组合， 尽量减少海龟的附带捕捞或死亡。最近的研究表明的积极结果有：− 使用偏移不超过10
度的大型回旋钩并且结合全鱼饵。这些措施表明在减少海龟相互影响和死亡方面有效；− 安排渔具布局和放置以便使鱼钩只有在海龟相互影响范围之外的深度发挥作用； −
早点收回延绳钓，减少鱼钩的浸泡时间；
(ii) 研究工作应当包括考虑各种减少措施对海龟、目标品种和鲨鱼及海鸟等其它附带捕捞品种的影响。
(iii) 保留并使用必要设备，适当放养附带捕捞的海龟，包括脱钩、绞线工具和抄网。
E．其它渔业
(i)对有关捕捞作业中海龟附带捕捞或死亡进行评估和监测。
(ii)研究和制定必要措施，减少附带捕捞或误捕或控制其它渔业中的死亡，着重减少刺网和定置网渔业中的附带捕捞或误捕。
(iii)在其它定置网渔业中，收集资料，认定海龟的相互影响，并对减少海龟附带捕捞或误捕及死亡的可能措施进行必要的研究。
(iv)实施因E(ii)和(iii) 的结果而制定的成功方法。
F．对所有捕捞方法适当的其它措施
(i) 对捕捞进行空间和临时控制，在海龟高度集中的地点和期间尤其如此。
(ii) 努力管理控制，尤其是如果目标品种或目标品种群体的养护需要这样做时。
(iii) 尽可能制定及实施渔网保留和再利用计划，尽量减少在海洋抛扔渔具和海洋碎片，并尽量促进其回收。
2. 研究、监测及信息分享
A．收集信息和数据及研究
(i) 直接收集或者通过有关区域渔业机构、区域海龟安排或其他机制收集关于所有渔业中海龟相互影响的数据和信息。
(ii) 在经济可行的地区制定可能对海龟产生影响的渔业观察员计划。在某些情况下可能需要提供财政和技术支持。
(iii) 与其他国家和/或粮农组织及有关区域渔业机构联合研究。
(iv) 在放养海龟成活可能性及误捕率较高的地区和时期方面进行研究。
(v) 在海龟养护和管理措施对渔民和捕捞业的社会经济影响方面以及改进通信的方法方面进行研究。
(vi) 利用捕捞社区海龟养护和管理的传统知识。
B．信息交流
(i) 直接或者通过有关区域渔业机构、区域海龟安排或其他机制分享和/或传播数据及研究结果。
(ii) 开展合作，以便统一数据收集和研究方法，如渔具和努力量术语、数据库开发、对海龟相互影响率的估计及时间和地区划分。
C．审查措施效益
(i) 不断评估根据这些准则所采取的措施的效果。
(ii) 审查上述措施的实施和改进。
3. 确保政策一致
A．在国家一级、有关政府机构之间（包括通过机构间磋商）以及区域一级，保持管理和养护政策的一致性。
B．保持和力争国家、分区域和区域各级有关海龟管理和养护法律的一致性。
4. 教育和培训
A．编制及分发信息材料，如小册子、手册和说明卡。
B．组织关于以下方面的渔民和捕捞业的研讨会：− 海龟与渔业相互影响问题的性质− 采取减缓措施的必要性− 海龟品种认定− 对附带捕捞或误捕海龟的适当处理−
有利于迅速安全放养的设备− 其活动对海龟的影响− 要求采取或需要采取的措施在多大程度上有助于海龟种群的养护、管理和恢复 − 减缓措施对捕捞作业盈利和成功的影响
− 对使用过的渔具的适当处理
C．由政府和其他组织来提高公众对海龟养护和管理问题的认识。
5. 能力建设
A．为发展中国家实施这些准则提供财政和技术支持。
B．在沿海渔业和公海渔业的海龟附带捕捞状况的研究活动中开展合作，在采食、交配和栖息地区进行研究。
C．建立自愿支持基金。
D．促进技术转让。
6. 社会经济和文化考虑
A．考虑到：
(i)在实施海龟养护和管理措施方面的社会经济问题。
(ii)渔业活动中海龟相互影响的文化方面以及在海龟养护和管理工作中的文化规范整合问题。
(iii)捕捞社区和沿海社区的海龟养护和管理利益，特别是小型渔业和手工渔业。
B．促进捕捞业、捕捞社区和其他有关利益相关者积极参与和合作。
C．充分重视参与性研究，利用渔民的本地知识和传统知识。
7. 报告
报告这些准则的实施进展情况，作为成员每两年就《负责任渔业行为守则》向粮农组织报告以及酌情自愿向区域海龟养护和管理安排等其他有关机构报告的一部分。
8. 考虑海龟养护和管理的其它问题
渔民、研究机构、管理部门和涉及渔业养护和管理的其他有关方面应当在国家、分区域和区域各级与有关养护和管理机构就以下主题开展合作：
A．收集和分享有关以下方面的海龟信息：
(i) 生物学和生态学（种群动态、种群认定、行为、食物选择、生境、繁殖、栖息、采食、迁移方式/地区、繁育场等）。
(ii) 除渔业之外造成死亡的其他原因。
(iii) 海龟种群状况，包括人为威胁状况。
B．制定和改进适用于海龟整个生命周期的养护和管理措施（生境/栖息海滩保护、增加海龟种群）。
C．酌情促进参加区域海龟养护和管理安排，以便在海龟养护和管理方面开展合作。
